The agreement

These terms are between you (the business using Trivex) and Trivex. By creating an account you accept them.

What we provide

Software for contacting and managing your customers by phone, text message and email, together with the phone numbers and sending infrastructure that make it work. We set those up on your behalf and they remain part of the service.

What you are responsible for

Who you contact, and whether you may. This is the important one. You confirm that you have a lawful basis to contact the people you upload, and that the information you give us about your business for carrier registration is accurate. Trivex enforces do-not-contact lists, quiet hours and consent rules automatically, and will refuse to send messages that break them — but the responsibility for the list you bring is yours.

Your account. Keep your sign-in details private and tell us promptly if you think someone else has them.

Lawful use. No unsolicited bulk messaging, no fraudulent or misleading content, and nothing illegal. We may suspend an account that puts our sending reputation or other customers at risk, and will tell you why.

Paying for it

A subscription plus usage — calls, text messages, emails and assistant activity are metered and billed with your subscription. Usage you have already run up is payable even if you cancel mid-cycle, because we have already paid the phone and email networks for it. You can cancel at any time and it takes effect at the end of the current period. We do not pro-rate partial months.

Your data

Your customer data is yours. We store and process it to run the service, as described in our privacy policy. You can export it or ask us to delete it. If you close your account we keep only what the law requires us to keep — principally consent and do-not-contact records, which exist to protect both you and the people you contacted.

Availability

We work to keep Trivex running and will tell you about planned maintenance. We depend on phone carriers, email providers and payment processors, and cannot guarantee uninterrupted service or that every message reaches its destination — no one honestly can.

Limits of our liability

Trivex is provided as-is. To the extent the law allows, our total liability is limited to what you paid us in the twelve months before the claim, and we are not liable for lost profits or indirect losses. Nothing here limits liability that cannot lawfully be limited.

Ending it

You can close your account whenever you like. We may end this agreement if these terms are broken, and except in serious cases we will give notice and a chance to put it right first.

Changes

If we change these terms materially we will tell account holders before the change takes effect.
